TERMS AND CONDITIONS FOR USE OF TOWN PROPERTIES
TOWN OF PARKER PARKS, RECREATION AND OPEN SPACE DEPARTMENT
These Terms and Conditions for Use of Parker Parks, Recreation and Open Space Properties apply to all use of facilities and park lands owned or operated by the Town of Parker (the "Town"), regardless of whether the purchase of a membership, admission, daily pass, rental agreement, or other compensation for use of the Facility (such as participation in a sports league) is necessary. In consideration for the use of the Properties, the individual, group, or organization purchasing a membership, pass, or rental and, when applicable, their members, employees, guests, participants, and agents (collectively, the "User"), agrees as follows.
- The Town owns and operates several "Facilities," including, but not limited to, the Parker Recreation Center, the Fieldhouse, and H2O'Brien Pool. The Town uses the Facilities for the Town's recreation programs. Facility and activity schedules are subject to change. The Parker Recreation Center and Parker Fieldhouse will close annually for a week-long scheduled maintenance; patrons will be given advanced notice. H2O'Brien Pool will close for the Parker Days event and as of August, will only be open on weekends.
- The Town owns and operates several “Park Lands,” including, but not limited to O’Brien Park, Discovery Park, Salisbury Park, Tallman Meadow Park, Stroh Ranch Soccer Fields, as well as all Town-owned trails, open space, and other parks. The Town uses the Park Lands for the Town's recreation programs. Park/Field and activity schedules are subject to change.
- The User agrees to abide by the applicable terms and conditions set forth on the Town of Parker’s Terms and Conditions Webpage, including, but not limited to: the General Use Waiver; the Medication Possession and Self-Administration Waiver; the Therapeutic Recreation Division: Use Agreement for Day Groups; the Park and Trails Rules and Regulations; and the Patron Code of Conduct.
- The User shall only use Properties for the agreed upon purpose and shall notify the Town of any activities that would be outside of typical venue usage.
- The User agrees to abide by all Town of Parker rules and policies posted in the Properties and comply with any instructions from Town staff with regards to the use of such Properties.
The User Further Agrees:
- Activities deemed unsafe, or behavior deemed inappropriate by the Town will be discontinued immediately and the User will surrender the premise upon demand of the Town.
- Private commercial activity is prohibited within the Property, without prior approval. This includes but is not limited to personal training and other sales of goods and services. Violation of this rule may result in removal from the Property and repeated violations may result in revocation of the User’s membership or day pass without a refund.
- To collect and remove all trash, litter, debris, etc. from the rental area assigned or used following each use.
- Not to use any Property if there is a danger that the surface will be damaged by playing on or after bad weather or other conditions have affected the surface. Removal of snow is prohibited.
- The Town reserves the right to employ security measures as the Town deems appropriate, at the User's expense. Town of Parker Police officers are available to contract for User's event through the Parker Police department and can be reached at (303) 841-9800.
- The Town is not responsible for any belongings of people using the Property. Any personal property left on premises by the User shall, after a period of 14 days, be deemed abandoned and become the property of the Town of Parker. The Town shall not be liable for any loss or damage to such property.
- Failure to comply with any of the requirements set forth in these Terms and Conditions may result in being prohibited from use of any Town Facilities or Park Lands in the future.
Security and Safety
- The User shall not allow any alcoholic beverages and/or illegal substances to be consumed on Town property or in Town facilities or Park Lands. User shall obey all applicable laws, rules, and regulations, including, but not limited to, Town of Parker Municipal Code Sections: 12.02.200 Unlawful consumption of alcohol beverages; 12.02.040-12.02.060 Vandalism, litter and glass containers prohibited; 12.02.100 Motor vehicles prohibited on Park Lands; 12.02.110 Illegal parking.
- Glass, alcohol, marijuana, tobacco or nicotine products including vapes and electronic cigarettes are not permitted in and cannot be used within 50 feet of Town Facilities.
- The User shall use only designated public parking areas, unless specifically authorized by the Town. The Town's Police Department may issue citations for illegally parked vehicles, or reckless operation of vehicles on Town property. Driving or parking on Town trails is prohibited.
- The User shall not alter, add, remove from, or improve the Facilities or Park Lands, without the prior written consent of the Town.
- The User shall notify the Parks, Recreation and Open Space Department as soon as possible of any damage, vandalism, needed repairs and/or safety issues. If damage is the result of User's members' negligence or failure to comply with accepted operational rules and regulations, User may be held responsible for reimbursing the Town for all or part of the repair costs.
- The User must enter and exit from the main entry points during normal hours of operation.
- It is strictly prohibited to prop open doors, or use doors for entering and exiting, unless authorized or in an emergency situation.
- If the User does not follow the rules or requirements of this Agreement, the applicable terms and conditions listed on the Town’s Waivers, Terms and Conditions webpage, or applicable laws, rules, and regulations, the User may be subject to removal from the Property. If deemed necessary, the Parker Recreation Department reserves the right to require a meeting with any violator prior to them being considered for reinstatement.
- If a user’s representative has repeatedly violated any of the above requirements, they may not be allowed to return to any Town Recreation Property. Repeated violations of this Agreement may result in termination of the User's rental agreement, membership, day pass, or other privileges to utilize Town of Parker facilities or park lands. Additional Terms and Conditions – Pool Use
- All Users are responsible for reading and obeying all additional rules and sanitary regulations posted at the pool.
- Lifeguards and management have the final authority.
- No running, pushing, dunking, horseplay, flips, or dangerous jumps.
- No private instruction by no-Town Recreation staff is allowed.
- Proper swimwear is required (no underwear or street clothing).
- Only U.S. Coast Guard-approved lifejackets are allowed.
- Devices that restrict mobility (e.g., mermaid tails) are prohibited.
- Weak or Non-Swimmers a. Non-swimmers should stay in shallow water with a parent/guardian who is in the water. It is recommended that non-swimmers use a Coast Guard-approved Lifejacket.
Billing and Payments
The User shall comply with the applicable Town of Parker Property Rental Payment Terms and Conditions.
